 I have been on DLA awarded with Special Rules since 1992. So i was not surprise to be landed a DBD551 in January 2008 (or was it November...?) Anyway, I got some advice and sent it back in January. Then I got a prompt reply saying they received it, thank you, and obviously my circumstances had changed, so  they would write to my doctor. Then nothing. A month later I called them and they told me I would need to fill a form. They would write to my doctor first. So I started the painful process to gather all evidence of anything that happened to me healthwise in the last, let's say, couple of years. I have had all sorts of bits and pieces some small some bigger. In the meantime I have also started full time self employment (now reduced again to part time as I cannot sustain it thank you very much). Anyway, I waited and waited. Then rung again. They were going to write to my doctor. So I waited. In july I got a letter saying they had written  to my doctor. So I waited. Then I saw my doctor, she said she did not see any letter from them. However, I think I did see some form of correspondence from DLA once when I was attending a different clinic with the same huge medical file. It was right on the top of the file. Yet a couple of weeks later it was not in the file and the doctor didn't see it. We looked, it was not there. So, did I dream it? Did the doctor chucked it in the bin? Can they really take this long??To just send me a bloody form? I am reluctant to give them a call and  bollocks over the phone as they are still paying cheerfully away, but I just can't stand this wait any longer, have they given up??? Will they come knocking at my door just when I thought I was safe? Are they spying on me with little spy cameras out in the parking space? Has anyone else been waiting this long?

Your course of action.

The reviews do take several months. I was dealing with an issue early December with some that had started in January 08 and were awaiting medical reports. Though this has been done now.

You may consider the following :-

If the doctor has filled in a medical report for you it will be part of your notes. Make an appointment telling your doctor you want to see the medical report they submitted. Of course they may tell you they never received one.

Ask your doctor to write a letter, detailing your condition in the fullest terms. Tell them you need this for this claim. Get them to agree a deadline for giving the letter to you say a week or two.

If you are concerned ring the DWP and ask why their is a delay? Ask if they have received a medical report form from your doctor?. Keep the conversation short. They will be able to tell you if any report was sent to your doctor and when ( I note your mention of July but ask for the date)

If they have not, ask them to chase the doctor or send them the letter you requested above (take a copy for your records first). Send it to the DWP with a proof of posting from your local post office.

You could as them to send the forms to you to give to your doctor. This is at the end of the day medical evidence in support of your claim explain this to them if they seem reluctant.

In terms of employment. DLA is about your care and mobility needs, day & night not about the work you do or do not do or how many hours a week.

They will not call to your door.

review of d.l.a.

Hi my daughter has a.d.h.d. and is currently under a consultant (whom hasn't been very helpful). His attitude is if your not in a wheel chair then your not disabled!! We are going for her review next week and I am a bag of nerves can anyone help me please. What happens next what do they need to know  when everything is there for them, many thanks

review of d.l.a. / Daughter with ADHD

If you believe your daughter is subject to discrimination by her consulant than I would advise you complain to the hospital concerned.  The definition of 'disability' is contained in law formerly in Disability Discrimination Act and laterly the Equality Act.

You can write to your consultant and/or the Department for Work & Pensions using the Data Protection Act (www.ico.gov.uk) to see what comments, information and reports have been made about your daughter. Albeit that this would be after your assessment this week.

If you have completed all the forms, submitted the information they require then the next stage is the assessment.  You may not get the answer you seek on the first attempt.  It is common to "appeal" the original decision. if you do so ensure you go and get medical reports from all doctors and detailed.  If you disagree with what her consultant has said then he must demonstrate his position.
